    PRINCIPLES OF PRIVATE DATA REFINING

    We have to gather and use (to refine) certain types of data (Private Data) that relates to the people (Data Subjects) who we come into contact with to carry out our business.

    We are confident that when refining private data, individual rights must be protected which means that all private data must be gathered and refined legally and fairly.

    Therefore, we presume and agree that Private data shall be:

    • refined lawfully, fairly and transparently about the data subject (‘lawfulness, fairness and transparency)
    • gathered for specified, explicit and legitimate means and not further refined in a manner that is incompatible with those means (‘purpose limitation’)
    • adequate, relevant and limited to what is required about the means for which they are refined (‘data minimisation’);
    • accurate and, where required, kept up to date; every reasonable step must be taken to ensure that private data that is inaccurate, having regard to the means for which they are refined, is erased or rectified without delay (‘accuracy’);
    • kept in a form which permits identification of data subjects for no longer than is required for the means for which the private data is refined (‘storage limitation’);
    • refined in a manner that ensures appropriate security of the private data, including safety against unauthorised or unlawful refining and accidental loss, destruction or damage, using appropriate technical or organisational measures (‘integrity and confidentiality).

    LAWFULNESS OF REFINEMENT

    To make refining compliant, we should ensure it has at least one legitimate reason for refining (gathering, using, managing or disclosing) private data. According to Article 6 (1) of EU Regulation No 2016/679 (General Data Safety Regulation or GDPR) such reasons could be:

    • the data subject has given consent to the refinement of their private data for one or more specific means;
    • refinement is required for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject before entering into a contract;
    • refinement is mandatory for the legitimate interests provided by the controller or by a third party, except when such interests are overridden by the interests or major rights and freedoms of the data subject which require the safety of private data, in particular where the data subject is a child.
